Recycled Content Regulation: EU PPWR, US State Mandates and Compliance
Europe conditions market access on recycled content; California puts a price on missing it. What each rule requires, and which parts are still unwritten.
Recycled content in plastic packaging stopped being a purchasing preference and became law, first in California and then across the European Union. The two took different routes to it, and the difference decides how hard each one bites. This hub collects what we have written on the rules themselves.
The two regimes
- EU PPWR compliance guide. Regulation (EU) 2025/40: the recycled content minimums for 2030 and 2040, the exemptions, and the implementing acts that still have to be written before the 2030 date is fixed.
- California AB 793. Public Resources Code section 14547: 15%, 25% and 50% by year, averaged per manufacturer, with a twenty cent per pound penalty on the shortfall.
How they differ
Europe makes the minimum a condition of placing packaging on the market. California prices the shortfall and lets the manufacturer decide whether to pay it or buy the recycled resin. A price is a ceiling on what compliance is worth; a market access rule has no ceiling.
The European rule also has a date that is not yet fixed. Article 7(1) sets 1 January 2030 or three years after the calculation methodology enters into force, whichever is later, and that implementing act, due under Article 7(8) by 31 December 2026, is still in preparation. California's dates are already running.
Food contact is a separate gate
Recycled plastic that touches food has to satisfy Regulation (EU) 2022/1616 as well: made with a suitable recycling technology from its Annex I or a novel technology under its Chapter IV, with the individual recycling process authorised where relevant. Meeting a recycled content target does not make a material food-safe, and being food-safe says nothing about whether it performs.
